OCI for Kids (Minors)

The rules for minor OCIs are strict. Every time a child gets a new foreign passport (usually every 5 years for US citizens under 16), their OCI status must be updated on the VFS/Gov website.

Crucial Rule: If the child's passport is renewed before they turn 20 years old, the OCI card itself must be physically re-issued one time after they turn 20.

OCI for Adults

Once you are over 20 years old and your OCI is issued, you generally do not need to get the physical card re-issued ever again, even if you get a new passport (unless you turn 50, but recent rules relaxed this). Just carry the old passport containing the OCI U-visa sticker along with the new passport and OCI booklet.

Spouse-Based OCI

If your spouse is a foreign citizen of non-Indian origin, they can apply for a Spouse-Based OCI after 2 years of registered marriage. Note: If the marriage is ever dissolved, the spouse-based OCI is immediately cancelled.

What if OCI is pending? (E-Visa)

If you need to travel urgently and OCI processing is delayed (it takes 2-3 months), you can apply for an E-Tourist or E-Business Visa. E-Visas are granted within 72 hours. Once in India, you can exit and re-enter on the OCI once it is mailed to your overseas address (you will need a friend to courier it to you).

US Social Security: The 40 Credits Rule

How it Works

If you worked in the US on an H1B or Green Card and paid into Social Security (FICA taxes), you are entitled to collect a US Social Security pension at retirement age (62+) even if you live in India permanently.

  • The 40 Credits Requirement: You must have accumulated 40 quarters (credits) of coverage. You can earn a maximum of 4 credits per year. This means you need exactly 10 years of US work history to qualify for a payout.
  • What if I have less than 10 years? You will not receive any Social Security benefits, and the taxes you paid into the system are not refundable.
  • Payout in India: If you have your 40 credits, the US Social Security Administration (SSA) will wire your monthly pension directly to your Indian bank account (via the Federal Benefits Unit in Manila or directly from the US) when you reach retirement age.
  • Windfall Elimination Provision (WEP): If you also receive an Indian pension (like EPF), your US Social Security payout might be reduced under WEP rules.
